Losing your case in the New Hampshire Circuit Court or Superior Court may not be the end of the matter. The New Hampshire Supreme Court hears appeals from the lower circuit courts (probate, family law, and district) and the superior court (which handles more serious matters, such as criminal charges). An appeal of an adjudicated case (one in which a court has rendered a decision) isn’t simply a “do-over” or another chance to get the outcome you want. Instead, appeals are reserved for situations in which the lower court has made a legal error, or for mistakes or omissions at trial that could have affected the outcome. Some individuals may also petition the court to hear an appeal due to a lack of adequate legal counsel.
The state Supreme Court doesn’t automatically hear all appeals. Only if it reviews the petition and determines that there is an issue of law that must be addressed will the Court decide to hear the appeal.
